North Carolina Surveying Laws

Professional Land Surveyor Limited Right of Entry

North Carolina law (NC GS § 14-159.15, Article 22B of Chapter 14) grants professional land surveyors a limited right to enter upon the lands of others when necessary to perform surveys. This includes locating property corners, boundary lines, rights-of-way, and easements. Entry for surveying purposes does not constitute criminal trespass under NC law.

Key Provisions:

  • Licensed surveyors may enter property to perform the practice of land surveying
  • Surveyors may carry customary equipment and vehicles
  • Entry for surveying purposes does not constitute trespass or subject surveyors to arrest
  • Surveyors cannot destroy, damage, or move anything without written landowner permission
  • No notice to property owners is required by law
  • Does not apply to railroad property or critical infrastructure without permission

What this means for you: Our field crews can access neighboring properties when necessary to accurately establish your property boundaries. While the law does not require notice to adjacent property owners, we always attempt courtesy notification when possible, minimize impact, and take care not to damage property while fulfilling our professional obligations under NC law.

Professional Licensing Requirements

All land surveyors in North Carolina must be licensed by the NC Board of Examiners for Engineers and Surveyors. Our team includes multiple Professional Land Surveyors (PLS) who have met rigorous education, experience, and examination requirements.

Survey Plat Recording

North Carolina law requires certain surveys to be recorded with the county Register of Deeds. We handle the recording process for surveys that create new property divisions or are required for real estate transactions in Brunswick County.

Coastal Area Management Act (CAMA)

Properties in Brunswick County's coastal areas may be subject to CAMA regulations. Our surveyors are experienced in identifying CAMA jurisdictional areas, setback requirements, and working with local permitting authorities for coastal development projects.
